Adult Participant Waiver, Release & Agreement

Please read carefully before signing.

This Participant Waiver, Release of Liability, and Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Spark Workshops & Retreats LLC, its owner, facilitators, assistants, collaborators, contractors, volunteers, venues, and representatives (collectively, the “Company”).
 

1. Voluntary Participation

I understand that I am voluntarily participating in workshops, retreats, classes, events, and related activities offered by the Company (“Activities”). These Activities may include, but are not limited to, gentle movement, breathwork, meditation, mindfulness practices, journaling, group discussion, creative expression, time in nature, and educational experiences.

I acknowledge that participation is entirely voluntary and that I may stop or modify my participation at any time.
 

2. Assumption of Risk

I understand that the Activities involve inherent risks, including but not limited to physical exertion, emotional release, discomfort, injury, or unforeseen circumstances related to movement, environment, travel, or group settings.

I knowingly and freely assume all such risks, both known and unknown, arising from my participation, even if arising from the negligence of the Company, to the fullest extent permitted by law.
 

3. Medical & Mental Health Disclaimer

I understand and agree that:

• The Company does not provide medical, psychological, therapeutic, or counseling services.

• The Activities are not a substitute for professional medical or mental health care.

• I am solely responsible for my physical, mental, and emotional well-being.

• I have consulted (or will consult) a qualified professional as needed before participating.

I confirm that I am physically and emotionally able to participate and will notify facilitators of any limitations if necessary.
 

4. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, and discharge the Company from any and all claims, demands, causes of action, damages, or liabilities arising out of or related to my participation in the Activities, including but not limited to personal injury, emotional distress, property loss, or death.

This release does not apply to gross negligence or willful misconduct.
 

5. Indemnification

I agree to indemnify and hold harmless the Company from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from my actions or participation during the Activities.
 

6. Confidentiality & Group Respect

I understand that workshops and retreats may involve personal sharing. I agree to respect the confidentiality and privacy of other participants and to refrain from sharing identifying information or personal stories shared within the group.

I acknowledge that there is no obligation to share, and participation in group discussion is always optional.
 

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
 

8. (Electronic) Signature & Agreement

I understand that this Agreement may be executed electronically and that my electronic signature is legally binding.

• I voluntarily agree to all terms
